A state can become a Member or Non-Member party to the Hague Convention countries by ratification, accession, succession or continuation. However if a state becomes party to the Convention by Accession, it is possible for another country to raise objection against such accession.

In this situation the Convention will not enter into force between the states that objected and the state against whom the objection was raised. We have enlisted below the member states that entered into the Convention by Accession and the states that raised an objection.

Albania

Belgium, Germany, Greece, Italy and Spain raised an objection to the accession of Albania within the period of six months specified in Article 12, paragraph 2, and expiring on 10 March 2004.

However Belgium and Italy, later withdrew their objections on 21 December 2015 and 26 May 2011 respectively.

The Convention will not enter into force between Albania and remaining three countries i.e. Germany, Greece and Spain.

Azerbaijan

Netherlands, Germany and Hungary raised an objection to the accession of Azerbaijan before 1 January 2005.

The Convention will not enter into force between Azerbaijan and Germany.

India

Belgium, Finland, Germany, the Netherlands and Spain raised an objection to the accession of India within the period of six months specified in Article 12, paragraph 2, and expiring on 15 May 2005.

The Convention will not enter into force between India and Germany.

Morocco

The Convention will not enter into force between Morocco and Germany as on 14 June 2016, the Federal Republic of Germany objected to the accession of Morocco in accordance with article 12, paragraph 2 of the Convention Abolishing the Requirements of Legalization for Foreign Documents (The Hague, October 5th, 1961).

Paraguay

As the Federal Republic of Germany raised an objection to the accession of Paraguay on 10 June 2014, the Convention will not enter into force between Germany and Paraguay.

Peru

On 15 July 2010, the Ministry of Foreign Affairs of the Netherlands (depositary) was informed of the objection of the Federal Republic of Germany to the accession of Peru to the Convention Abolishing the Requirements of Legalisation for Foreign Public Documents.

However on 19 December 2013, the depositary was informed of the withdrawal of the objection by Germany. Therefore the Convention entered into force between Germany and Peru on 1 January 2014.

On 28 July 2010, the depositary was informed of the objection of Greece to the accession of Peru to the Convention Abolishing the Requirements of Legalisation for Foreign Public Documents.

The Convention will, in accordance with its Article 12, third paragraph, not enter into force between Greece and Peru.

Republic of Moldova

The Federal Republic of Germany raised an objection to the accession of Moldova on 5 January 2007. Accordingly the Convention will not enter into force between Moldova and Germany.

Georgia

Germany and Greece raised an objection to the accession of Georgia. However both the countries withdrew their objections on 2 February 2010 and 17 December 2015 respectively.

 

Ukraine

Belgium and Germany raised an objection to the accession of Ukraine within the period of six months specified in Article 12, paragraph 2, and expiring on 23 October 2003. However both the countries withdrew their objections on 5 July 2004 and 22 July 2010 respectively.
